Challenges and Legal Implications of Collaborative Robots Leaving Safety Enclosures

The German government aims to introduce adaptable robots into factories through the AI-robotic booster initiative. However, legal aspects such as the Data Act and liability regulations are struggling to catch up with this technological advancement. Joint-arm robots are versatile tools in industrial automation, typically equipped with six standard axes, some even featuring seven or two arms. These robots weld, assemble, and mimic human movements, traditionally operating within enclosed safety barriers. Alexander Baghal-Schmid, a technology-focused lawyer at CMS Germany, explains that traditional robotics has been characterized by predictability for decades. Industrial robots executed pre-programmed movements within dedicated secured areas. Today, robots are breaking free from these confines and collaborating side by side with humans, introducing new risks and legal uncertainties in the working environment.

Collaborative robots, known as Cobots, interact directly with employees without the need for safety barriers, assisting in tasks like assembly and quality control. Despite utilizing sensors and force limitation techniques for safety, collisions and injuries remain potential risks. Moreover, questions arise regarding the hierarchy of control between robots and human workers. As robots transition from being mere assistants to potentially dictating workflows, employees risk becoming mere appendages to machines. Additionally, the constant surveillance by cameras and sensors not only aids collaboration but can also be exploited for comprehensive performance monitoring, raising concerns for workers’ representatives regarding data privacy and surveillance issues.

The German government initiated funding programs earlier this year to support the key technology of Artificial Intelligence. The “AI-robotic booster” initiative aims to bridge academia’s foundational research with practical industrial applications, advancing the integration of robots in various industries. The concept of “Embodied AI” refers to learning robots that combine AI, sensors, and actuators, enabling them to perceive their surroundings, act upon them, and learn from the outcomes. This initiative includes flagship projects for multifunctional robots, demonstrations of embodied AI applications showcasing the technology’s potential for the economy, enhancing research infrastructure, and setting up testing and training facilities.

Despite the promising technological advancements, legal complexities abound. It’s essential to acknowledge that regulations such as the EU Data Act play a crucial role in governing these technologies. The EU Data Act ensures fair data access and utilization rights for users of connected devices, classifying a connected robot as a “connected product.” Manufacturers are required to design products ensuring seamless data access for users, including mechanisms for data export. Disputes often arise concerning data ownership in this context. The integration of Embodied AI provides machines with perception abilities, transitioning from laboratory settings to real-world applications more economically through enhanced sensor technologies.

Although this development streamlines machine learning processes and reduces costs, it also raises privacy concerns when robots collect personal data through cameras, microphones, and sensors, triggering compliance requirements under the General Data Protection Regulation (GDPR). Furthermore, the autonomy of embodied AI systems increases liability risks for companies. A ruling from the District Court of Kiel dated February 29, 2024, stated that businesses can be held liable for misinformation generated by AI systems they employ, even if the data was automatically generated and disclaimers were incorporated in the terms of use.
